Resident Online Services and Credit Card or ACH Payments Acknowledgement
 
 
Resident acknowledges that your Landlord offers certain online services to residents, including a service that provides residents with the option to make rental payments by credit card or from a checking account (electronic check/ACH) initiated online through Yardi Online Payments™ (Rentcafé™) (“Yardi”), an independent service provider not affiliated with Hankin Apartments or your Landlord.  This online payment option through Yardi is voluntary and not obligatory. Residents are not required to make any rental payment through Yardi. To obtain this service, residents must elect to register with or sign up for the online rental payment service directly through Yardi and the terms of use of such service will be governed solely by any agreements between Yardi and resident. 
 
Resident specifically acknowledges that Hankin Apartments and your Landlord are not responsible for the privacy and security of any information resident may provide to Yardi in connection with the activation of an online rental payment service through Yardi or the initiation of any online rental payment to your Landlord through Yardi, including, without limitation, the identification of Resident’s billing address, bank and/or credit card account numbers, and credit card expiration dates. Resident is solely responsible for maintaining the confidentiality of Resident’s user I.D., password, and other access code required by Yardi for the use of their online payment service. Hankin Apartments and your Landlord are not responsible for any activities occurring under Resident’s user I.D., password, or access code for the Yardi service.  Resident expressly agrees and understands that it is Resident’s sole responsibility to review the privacy and data security policy and related representations provided by Yardi prior to signing up or registering with Yardi to make online payments to Landlord to ensure that residents understands and accepts those specific terms of use of the online payment service provided by Yardi, as the same may be changed by Yardi from time to time. 
 
Landlord assesses a fee of $20 per credit card or debit card (there is no fee for electronic check or ACH payments) transaction for the receipt of rental payments made by residents through Yardi. Resident should, however, review the terms of use of his/her agreements with Yardi and his/her bank and/or credit card account agreements to determine whether Yardi and/or his/her bank or card issuer may assess fees or charges in connection with such payments. ACH payments set up by a resident to automatically withdraw on a monthly basis will withdraw between the 1st and 4th day of every month (or if the 4th day falls on a Sunday or bank holiday, withdrawals will occur on the next available business day following the 4th of the month) as set up by the resident. In the event of a lease renewal, ACH payments set up by a resident to automatically withdraw on a monthly basis will continue to occur through the new lease term WITHOUT a resident's reauthorization. Automatic ACH payments can be cancelled by the resident at any time.
 
When residents enroll in Pay What I Owe, the money you owe for all Rent, including, but not limited to, basic rent, pet fees, late fees, utility charges collected by Landlord, and any lease termination fees (two months’ rent), will be withdrawn from the account your provide automatically between the 1st and 4th day of each and every month via Automated Clearing House (ACH) transaction, until your lease ends or until you unenroll from Pay What I Owe.
 
You may set a limit on the amount of money Pay What I Owe can withdraw from your account in any given month. If you owe more than Pay What I Owe is allowed to withdrawal from your account, and you fail to pay the amount owed in full when it is due, you may still be subject to late fees or other penalties.
 
The amount due for Rent is calculated by the Landlord, in accordance with the terms of your Lease. Tenant may dispute any ACH withdraws made by landlord by emailing the Landlord a description on that withdraw. You may unenroll in Pay What I Owe at any time by stopping your recurring ACH payment.
 
Resident acknowledges that Yardi has no authority to act on behalf of or bind Hankin Apartments and your Landlord, and Hankin Apartments and Landlord are not bound by any representation of any kind by Yardi to any resident with regard to the obligations of Landlord to resident or any other person, or of resident or any other person to Landlord, under any law, lease, license, contract, or otherwise, whether related to the terms or conditions of the online rental payment service or otherwise.
 
Resident acknowledges that, at any time, Hankin Apartments and Landlord may elect to no longer accept rental payments made by residents through Yardi.
 
Hankin Apartments and Landlord make no representations or warranties, either expressed or implied, in any way regarding the services provided by Yardi, including, but not limited to Rentcafé, and shall not be liable for any claims or losses, including any and all claims or losses regarding the privacy and security of the information provided by resident to Yardi, relating to resident’s activation of the Yardi online payment service and/or use of the service to initiate and/or make one or more rental payments to Landlord. Resident hereby waives, disclaims and agrees not to assert any and all claims of any kind which Resident may have, now or in the future, against Hankin Apartments or Landlord arising, directly or indirectly, under or in connection with the services provided by Yardi.
 
Resident acknowledges that Hankin Apartments and Landlord may use other online services provided by Yardi that may permit residents to, among other things, renew their lease agreement, send in a maintenance request, view the community calendar, or change their personal information, such as telephone and tag numbers. Such services may require a user ID and password for access.
